Agency of Agricultural and Rural Development, was established on 30.12.2008 based on D.C.M. No. 1443 “On the establishment, organization and functioning of the Agency of Agricultural and Rural Development (ARDA), in the Guideline no. 3, date 30.12.2008 of the Minister of Agriculture, Food and Consumer Protection.

This institution strictly carries out the following-up and the implementation of the Law on Agriculture No. 9817, date 22.10.2007, of the respective DCMs “On the determination of the basic criteria for the sectors to be supported and the measures to benefit from the fund program of agriculture and rural development “, as well as” On the management of the support fund for agriculture “, defined by relevant guidelines.

Pursuant to Article 100 of the Constitution, point 3 of Article 21 of Law No. 9817, date 22.10.2007 “On Agriculture and Rural Development”, and Article 10 of Law No. 9000, date 30.1.2003 “On the Organization and functioning of the Council of Ministers “, upon the proposal of the Minister of Agriculture, Food and Consumer Protection, Council of Ministers.

DECIDED:

Establishment of the Agency of Agricultural and Rural Development (ARDA), as the Paying Agency, within the meaning of Article 21 of Law No. 9817, date 22.10.2007 “On Agriculture and Rural Development”.

ARDA has a central structure and local structure at the regional level.

The Director of ARDA is appointed, released or dismissed by the Prime Minister, upon the proposal of the Minister of Agriculture, Food and Consumer Protection. Managers and other employees of this agency, including those of local structures, are admitted under the procedures laid down in the civil service legislation. The number of agency employees is 86.

ARDA is responsible for administering the funds of the program of agriculture and rural development, as follows:

  1. a) State Budget Funds, for direct support of agricultural production;
  2. b) State Budget Funds, for the development of agricultural market infrastructure;
  3. c) Counterpart Funds, project 2KR.

The general criteria for using counterpart funds, project 2 KR, are determined by a special decision of the Council of Ministers.

ARDA drafts an action plan for the approximation of its organizational structure and its management and technical capacities, with EU accreditation standards.

ARDA designs and proposes projects as well as measures to create and administer IT databases and logistics needed for its operation according to EU standards.

ARDA will start operating on January 1, 2009.

The financial effects deriving from the implementation of this Decision will be borne by the State Budget, approved for the Ministry of Agriculture, Food and Consumer Protection.

The rules and procedures for the internal functioning of ARDA as well as the division of tasks, responsibilities and competencies between it and the Regional Directorates of Agriculture, Food and Consumer Protection (RDAFCP) and other actors of the agriculture and food system, are determined by special instruction of the Minister of Agriculture, Food and Consumer Protection.

The Ministry of Agriculture, Food and Consumer Protection is charged with the implementation of this decision.

This decision enters into force after its publication in the Official Gazette.
